Do you need a permit for a pool or hot tub in Atlanta, GA?

It depends on the details of your project.

Since January 2, 2025, Atlanta requires a pool permit to be filed on its own, with separate trade permits, apart from any other permit for the property.

Pools are not allowed in any yard next to a street in Atlanta's residential districts without a Board of Zoning Adjustment special exception.

Pool equipment may sit in a required yard only if it stays within 44 in of the ground.

A person last checked these rules on October 22, 2026. This is guidance only, so confirm with Atlanta before you build.

Permits a pool or hot tub can need in Atlanta

PermitWhen it applies
Swimming pool permitAtlanta's Office of Buildings permits residential pools on a separate application with pool details, structural and site plans. Factory-built spas go through Express Lane. The code exempts only repairs.
Electrical permit (separate trade permit)Atlanta requires separate trade permits for every swimming pool, and a trade permit to install any electrical equipment such as pumps, heaters and lights.
Floodplain development permitAll development in a FEMA special flood hazard area needs a floodplain permit.
Certificate of appropriateness (Urban Design Commission)In a Landmark or Historic District, or on a landmark or historic building or site, erecting a new structure or changing the exterior needs a certificate of appropriateness from the Urban Design Commission (Zoning Ordinance § 16-20.007), and the building code's permit exemptions don't apply. Conservation Districts need Commission review and written recommendations instead of a certificate.
